Question: I am a widow, and I fell in love with a man whom I got married. Out of desperateness, my current husband married me by providing mahr and just witnessing Allah that we are husband and wife thus, we have physical relationship as husband and wife. Now I am a bit concerned that without any human witness is our marriage valid? If it is not valid, then what is the process to validate it?

Answer: The marriage to be valid according to Shariah, there has to be during the Ijab and qabul (proposal and acceptance) by man and woman, at least two male witnesses and or one male and two women witnesses excluding the Nikha conductor.

Without this requirement the marriage is not authentic. Marrying by making witness to Allah during the Nikah is not valid. As per your question your marriage is not valid. Therefore, having relationship like a husband and wife is completely haram.

Now if you want to have a valid Nikah, then you must fulfil the requirement as mentioned above. Particularly, without ijab-qabul and witnesses the marriage is not valid.

Question: According to the Shariah, how old a bride and a groom has to be to get married?
Answer: Shariah did not place any specific rule regarding age for a bride or groom to get married. This all depends on the party when they’re ready to get married after becoming mature. Again there is no specific rule for both to have different in age, however, in practical sense there do exist age differences between both and this all depends on how each other accept it.

Moreover, it should be born in mind that the Prophet s.a.w has encouraged us to get married soon as possible especially when one has a strong feeling that without getting married it will be impossible to keep the chastity, i.e keeping away from committing adultery or sin.

Now the time is the “time of fitnah”, with all our surroundings and modern means, it is more prevalent to fall in to the trap of committing sin than ever before. Thus, it is strongly advised to follow the Sunnah of the Prophet s.a.w. to protect ourselves.

Answer: Literal meaning of Mut’ah is to benefit from something. Mut’ah marriage refers to a temporary time, for example a man marries a woman for a length of period in lieu of a particular amount of money. This is a pre-Islamic tradition existed in Arab culture. Even at the beginning of Islam, this Mut’ah was permitted for a temporary time till it was abrogated and became haram permanently. The main principle concerning the marriage is that it should be for ongoing and permanent and not just temporary.

Since it was abrogated, no madhahib permits this practice and now only the corrupt Raafidi (i.e one branch of Shi’ah) upheld this prohibited practice. Overall this was pre-Islamic practice and not invention by Islam, just like the wine was a common practice from pre-Islamic time and latter was prohibited, thus, this Mut’ah marriage was abrogated forever until the day of Judgement.
